 PROBLEMS TO AVOID

To avoid a tax problem, one must be able to anticipate and thereby sidestep the problem. The following questions will be discussed: Will an appraisal be needed for one or more of the assets to be donated? If donor sets up a charitable remainder unitrust with appreciated TESLA stock, what asset has donor given to the remainder beneficiary of the unitrust? Does the donor know the basis of each asset to be donated? If donor has made a pledge to CHARITY, may some third party (such as donor's private foundation) pay the pledge? Has donor obtained from CHARITY a good gift receipt (i.e., good for federal tax purposes)? If donor has named CHARITY as a beneficiary of her IRA, will CHARITY ever receive the benefit from the IRA custodian? If donor instructs BROKER to wire stock to CHARITY to establish a gift annuity and the stock drops in value while being transferred to CHARITY, what value is to be used to compute donor's annuity payment?

Jonathan Tidd has worked in gift planning since 1976 and has managed a planned giving program (NYU [1980-1981]). Currently, he takes only charities as clients and work with a WHO's WHO of charities across the U.S., including two IVY LEAGUE universities.

NOTE: The meeting is in person but the speaker will be virtual.

There is continuing education credit pending for attorneys and accountants. Credit has been approved for CFP (financial planners).
